By using the HandCash Market, a service owned and operated by HandCash Labs USA, Inc. (collectively referred to as "HandCash", "we", "us", or "our"), you ("User", "you", "your") are agreeing to the terms of service ("Terms") as set forth below. These Terms govern your use of the HandCash Market and the services provided therein ("Services").
HandCash Market is a platform for buying, selling, and trading Non-Fungible Tokens ("NFTs"). Users may connect their digital wallets to the platform in order to facilitate these transactions. HandCash charges a fee for each transaction conducted on the platform.
By using the HandCash Market, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
To access some features of the Service, you will need to register for an account. When registering an account, you agree to provide accurate, current and complete information about yourself.
HandCash charges a transaction fee on each operation conducted on the platform. Fees are subject to change at our sole discretion. You agree to pay all applicable fees related to your use of our Services.
HandCash Market offers a referral program whereby NFT creators and other affiliates can earn money per operation. Participation in the referral program requires a separate agreement with HandCash. The specific terms of this agreement will be determined on a case-by-case basis.
By listing an NFT on HandCash Market, you represent and warrant that you are the rightful owner of all rights to the NFT, and you grant HandCash a worldwide, non-exclusive, royalty-free license to use, copy, and display the NFT for the purposes of operating, promoting, and improving our Services.
HandCash reserves the right to suspend or terminate your account and access to the Services at any time, without notice, for any reason, including but not limited to breach of these Terms.
To the maximum extent permitted by law, HandCash shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the services.
These Terms will be governed by the laws of the State of Delaware without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or our Services shall be instituted in the federal or state courts located in Delaware.
HandCash reserves the right to modify these Terms at any time. If we make changes, we will post the amended Terms on our platform and update the "Last Updated" date above. Your continued use of the Service after we publish or send a notice about our changes to these Terms means that you are consenting to the updated Terms.
